Terms of Service
These Terms of Service ("Terms") govern your access to and use of Breaking Free Book Portal. By creating an account, listing content, or making a purchase, you agree to these Terms.
Platform role
Breaking Free Book Portal provides marketplace infrastructure. Booksellers are independent sellers responsible for their listings, pricing, and compliance with applicable laws. We facilitate payments, delivery tools, and moderation but are not the publisher of seller content unless explicitly stated.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract. Booksellers must provide accurate registration information and complete required onboarding, including Stripe Connect where card payments are used.
Bookseller obligations
- Own or have rights to sell all uploaded books, music, and related materials.
- Provide accurate descriptions, previews, and pricing.
- Choose a bookseller plan before submitting content for publication.
- Complete Stripe verification before accepting card payments.
- Configure an Ethereum wallet if offering or receiving ETH payments.
- Not list unlawful, infringing, deceptive, or harmful content.
Publication and moderation
New books and music may require admin approval before appearing on the storefront. Unpublishing items with existing sales may require admin approval. We may reject, suspend, or remove content that violates these Terms or poses legal or security risk.
Buyer purchases
- Prices are set by booksellers unless otherwise shown at checkout.
- Digital purchases generally grant personal access via My Library—not ownership of copyright, and not a license to redistribute files or stream links.
- Book access may require a password you select at checkout; keep it secure.
- Preview samples are provided for evaluation and may differ from the full product.
Payments and fees
Card payments are processed through Stripe Connect. Platform and affiliate fees (when applicable) are deducted via Stripe application fees. Sellers receive the remainder according to Stripe payout schedules.
ETH payments, when enabled, use an on-chain escrow contract with a hold period before release. ETH amounts are converted from listed USD prices using a configured spot rate at checkout—not a live market feed unless otherwise stated. Blockchain transactions are irreversible once confirmed.
Bookseller plans: Launch (free), Creator, and Professional annual plans set your book platform fee and catalog limits. Paid plans renew yearly via Stripe unless cancelled. Legacy one-time listing fees, if previously paid, are credited toward Creator access as described at checkout.
Affiliate program: eligible referrals via ?ref=memberId may earn a commission when enabled on a product. Affiliate membership may be verified through third-party smart contracts. Commission timing and payout method depend on payment type (Stripe vs escrow).
Refunds and disputes
Unless required by law or explicitly offered by a bookseller, digital sales are generally final. ETH escrow orders may support a dispute window before release, subject to platform rules and on-chain contract terms. Contact the bookseller or platform support for purchase issues.
Prohibited conduct
- Sharing purchased stream links, flipbook access, or download credentials.
- Circumventing access controls, affiliate tracking, or payment flows.
- Uploading malware, spam, or content that violates intellectual property or privacy rights.
- Impersonating others or misrepresenting affiliation with Breaking Free Book Portal.
Intellectual property
Platform software, branding, and design are owned by us or our licensors. Booksellers retain rights to their content subject to the license granted to us to host, display previews, and deliver purchases.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE CHECKOUT, OR ACCURACY OF ETH/USD CONVERSION RATES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS.
Indemnification
Booksellers agree to indemnify and hold harmless the platform from claims arising from their content, listings, tax obligations, or breach of these Terms.
Termination
We may suspend or terminate accounts for violations of these Terms. Buyers who purchased content before termination may retain library access as described at the time of purchase, unless removal is required by law or the seller's rights lapse.
Changes
We may modify these Terms. Material changes will be posted on this page. Continued use after changes constitutes acceptance.
Governing law
These Terms are governed by the laws applicable to the platform operator's principal place of business, without regard to conflict-of-law rules. Disputes should first be directed to your bookseller or platform administrator.
